Attorney Mike Kiley passes away at home
By Mishele Wright and Brett Wallace
mdwright@chronicle-tribune.com
Published: Wednesday, May 21, 2008 1:11 AM EDT
Mike Kiley, 73, a former Marion city judge who was a practicing attorney in the area for nearly 50 years, died Tuesday.
Joe Certain, Kiley's partner in law for 35 years, confirmed that Kiley died suddenly while having lunch at home Tuesday.
"He was a real local icon," Certain said. "Nobody in this town didn't know Mike. He was a very good, close friend of mine."
Kiley served two terms as city judge, from 1963 until 1970. He was also a former public defender. He was a former attorney for the Marion School Board and worked as counsel for the city of Marion on its development-bond issues. He was also a former commissioner for the Indiana Department of Natural Resources Commission.
State Rep. Tim Harris said many people know Kiley's accomplishments at the local level, but few know what he did for the area at the state level. He said he was grateful that the state officials had the opportunity to honor Kiley a couple years ago for his work on the DNR commission.
Although Kiley was a Democrat and Harris is a Republican, the two were still great friends and enjoyed wonderful conversations with one another, Harris said.
"It's sad, obviously," he said. "Mike's been a good friend for a long time. I enjoyed being able to talk to him and get advice from him. I will really miss that a lot."
The Marion native earned his law degree from Georgetown University and returned to his hometown to practice law. He was actively involved with many community boards and activities upon his return in the late 1950s. Kiley was named a Sagamore of the Wabash by former Gov. Robert Orr in 1989.
Certain said he and Kiley had just received word Monday that a former partner at Kiley Harker and Certain who had moved out-of-state, George Osborn, had recently died as well.
"This community, all of us , lived through an era of an individual who made terrific contributions to the community, in Marion, in Grant County and statewide," Certain said. "We're a lot worse off for him not being here."
Mayor Wayne Seybold said Kiley was a close friend of his family and also a tremendous asset to the city government.
"He helped the city whenever he could," Seybold said. "He's going to be sorely missed in his professional capacity as well as personally."
Marion city councilman Steve Wright was saddened by the news of Kiley's death Tuesday afternoon.
"Marion's lost a true friend to the community," he said. "I think Mike was a huge supporter for Marion and the efforts we're trying to do here."
Wright said he and Harris were together Tuesday when they learned that Kiley had died.
"Both our jaws dropped," he said.
Wright said Kiley came into the city council chambers often, representing many clients, and he was good at his job. He said he also remembers Kiley as a flamboyant person who loved Notre Dame, and he attended many football games and tailgated with him.
"I think Mike was very dedicated to the city," Wright said. "He was a huge Notre Dame fan, and he got the rest of us thinking Notre Dame was the team."
"He was just a great guy," Wright said. "He's somebody the community will definitely miss."
Kiley is survived by his wife, Carol, and three children, Anne, Dan and Matt.
Services are pending at Needham-Storey-Wampner Funeral Service, North Chapel.
A Mass will be celebrated on Campus by the Holy Cross priests for Mike from his ND56 Classmates. The Kiley residence address is: Mrs. Carol Kiley, 1371 Pine Bluff Dr.; Marion, IN 46952
MIKE KILEY'S FUNERAL NOTES:
(this was written by Jamie Kimmel Eifert , who served on the National ND Alumni Assoc. Board with Mike; she later served as President of the NDAA)
I was fortunate to have the opportunity to go to Mike's funeral yesterday and I signed the guest book "Representing the NDAA Former Alumni Board, especially 1998-2001". I traveled the 3 hours from Cincinnati with one of Mike's '56 classmates, Jim Mense. Jim had some great stories to share about Notre Dame in the 50's in general, and a few of his exploits with Mike, specifically.
The funeral was beautiful. The church was packed full, as you would expect. It looked like most of Marion and Lake Wawasee were in attendance. The homily was a perfect blend of scripture and comfort along with anecdotes about Mike, both funny and serious. Mike's impact on his parish and local community were very evident and the pastor clearly loved Mike as much as we all do. The priest included the story that many of us had heard Mike tell about his childhood when Fr. McCarthy told Mike's dad that "It's either going to be him (Mike) or me (Fr. McCarthy), and it's not going to be me!" None of Mike's famous stories about ND's Prefect of Discipline made it into the homily, though... :)
The first reading included this appropriate scripture from Daniel 12:
"At that time there shall arise Michael, the great prince, guardian of your people; It shall be a time unsurpassed in distress since nations began until that time. At that time your people shall escape, everyone who is found written in the book.
Many of those who sleep in the dust of the earth shall awake; some shall live forever, others shall be an everlasting horror and disgrace.
But the wise shall shine brightly like the splendor of the firmament, And those who lead the many to justice shall be like the stars forever. "
The pastor mentioned that when Carol was choosing the readings, the first one she picked was the Gospel reading, which included the admonition:
"Be sure of this: if the master of the house had known the hour of night when the thief was coming, he would have stayed awake and not let his house be broken into.
So too, you also must be prepared, for at an hour you do not expect, the Son of Man will come."
The pastor reassured that Mike had certainly lived his life in a state of readiness, and was a good and faithful servant whose life was centered around service to others.
After the Eucharist, Mike's son, Dan, offered some personal remarks that were an ideal tribute to Mike's life and sense of humor. Although the program did not list what the recessional music was going to be, Jim and I were gratified that it was "Notre Dame, Our Mother," followed by a refined church organ rendition (!!) of the Notre Dame Victory March. Outside the church doors, a bagpipe continued the Victory March as guests exited the service.
With a three-hour drive ahead of us to get back home, we opted not to go to the graveside service and so didn't have a chance to talk with Carol. Mike and Carol were just about 4 weeks shy of their 50th anniversary, so obviously it is going to be quite an adjustment for her to be alone after so many years with Mike. But it was apparent at the funeral that she will be surrounded by the love and prayers of many, many friends and a wonderful family. That, along with the comfort of her faith, will certainly help her get through.
Paul C. Colligan, M.D. 73 died suddenly on Thursday, May 15, 2008. He was born in Fort Wayne Indiana on August 10, 1934, one of ten children of Joseph and Marie (Hoffman) Colligan. A longtime resident of Saginaw, MI, Dr. Colligan retired from Saginaw-Covenant Hospital in Saginaw following 30 years of medical practice. Both he and his wife Rosie have been spending winters in Naples, FL for the past 15 years and recently moved there permanently.
